Sale Or Purchase Of Leased Property


Payments are issued according to the titled owner of record. Payments will not be transferred to a different owner without a recorded document of conveyance. When a mineral interest, royalty interest, working interest or overriding royalty interest is sold or purchased, it is the responsibility of the purchaser to furnish a complete copy of the conveyance document recorded in the county and state where the producing property is located. Please include the name, address, Social Security number or Federal Tax ID number of the new owner(s).

Change Of Ownership As A Result Of Divorce


A complete copy of the Divorce Decree, including the property settlement and copies of recorded conveyances, are required.

Death Of An Owner With A Will


In order to transfer the interest to the rightful heirs, the following documents are required:
  1. A certified copy of the decedent’s death certificate.
  2. A copy of the Probated/Recorded Last Will and Testament, made of record in the county and state where the producing property is located.
  3. Letters of administration.
  4. The names and addresses of the heirs.
  5. Copies of any appropriate recorded conveyances.

Death Of An Owner Without A Will


If an owner dies without a will, the following will be required in order to transfer the interest to the rightful heirs:
  1. A certified copy of the decedent’s death certificate.
  2. Affidavit of Heirship/Descent, completed by a third party who does not have a monetary interest in the transaction, and recorded in the county and state where the producing property is located.
  3. Letters of administration.
  4. The names and addresses of the heirs.

Life Tenant Dies


When an owner of a Life Estate dies, the following will be required in order to transfer the interest to the rightful heirs:
  1. A certified copy of the decedent’s death certificate.
  2. The names, addresses and Social Security numbers of the individuals who own the remainder and who succeed to the interest.

Power Of Attorney


When an owner is represented by an Attorney-In-Fact, a copy of the Power of Attorney document must be provided in order to establish the extent of power given to the Attorney-In-Fact by the owner.

Guardianship


Please provide Letters of Guardianship issued by the court when an owner is a minor or is declared incompetent. Please provide a copy of the minor’s birth certificate when a minor reaches legal age.

Trusts/Partnerships


When a Trust or Partnership is created, please provide a copy of the Trust Agreement and the recorded conveyance to the trust.
When a Trust or Partnership is dissolved, please provide a copy of the Instrument of Dissolution and recorded conveyances.
When there is a change in Trustee, a copy of the instrument whereby the successor Trustee was appointed will be required.

Termination Of Joint Tenancy Upon Death


Upon the death of an owner, the following documents are required:
  1. A certified copy of the decedent’s death certificate.
  2. A copy of the Deed showing the Joint Tenancy.
  3. The name and address of the successor in interest.
